Terms of Service

These Terms of Service (“Terms”) govern your use of the Horarium mobile application (the “App,” package com.TheGuayabaCompany.horarium), provided by the developer of Horarium (“we,” “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

01License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use, subject to these Terms and the Google Play Terms of Service. You may not copy, modify, reverse-engineer, distribute, or create derivative works of the App except as permitted by law.

02Acceptable use

You agree to use the App only for lawful purposes and not to misuse it: for example, by interfering with its operation, attempting to gain unauthorized access, or using it in a way that violates applicable law. You are responsible for the content of the routines and tasks you create.

03Pro & subscriptions

The App is free to use with certain limits. An optional Horarium Pro upgrade unlocks additional features and is offered in these forms:

All purchases are processed through Google Play Billing and charged to your Google account. Subscriptions renew automatically at the then-current price until you cancel. Google will charge the renewal within 24 hours before the end of the current period. Prices are shown in the App before purchase and may change; we will give notice of price changes as required, and changes to a subscription price take effect only after notice and, where required, your consent. The set of features included in Pro may evolve over time.

04Cancellation

You can cancel an auto-renewing subscription at any time through the Google Play Store: open Play Store → Profile → Payments & subscriptions → Subscriptions, select Horarium, and choose Cancel. Cancellation stops future renewals; you keep Pro access until the end of the period you have already paid for. The Lifetime purchase is one-time and has nothing to cancel.

05Refunds

Purchases are handled by Google, so refunds are governed by Google Play’s refund policy. You can request a refund directly through the Google Play Store or your Google Play order history. Where the law of your country grants you additional or non-waivable refund or withdrawal rights, those rights continue to apply. If you have a billing concern, you may also contact us and we will try to help, though refunds are ultimately issued through Google.

06Alarm reliability & health disclaimer

Horarium is a productivity aid, not a guaranteed alerting system. Alarm delivery depends on your device: its operating system, battery-optimization settings, Do Not Disturb mode, volume, and manufacturer power management can delay or prevent an alarm. Please do not rely on the App alone for time-critical, medical, or safety-critical needs. Use an independent backup for anything where a missed alert would be harmful.

Horarium is not a diagnostic, therapeutic, or medical device, and it does not provide medical or mental-health advice. It is not a clinical tool for ADHD, autism, or any other condition, and using it is not a substitute for professional evaluation, diagnosis, or treatment.

07Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that alarms will always fire as intended. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

08Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, missed events, or missed alarms, arising out of or relating to your use of the App. Where liability cannot be excluded, it is limited to the amount you paid for the App in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under the law of your country.

09Termination

You may stop using the App and uninstall it at any time. We may suspend or terminate your access if you breach these Terms or where required by law. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.

10Changes

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for significant changes, provide notice within the App. Your continued use of the App after an update means you accept the revised Terms.

11Governing law

These Terms are governed by the laws of the United Mexican States (Mexico), without regard to conflict-of-law principles. The courts located in Mexico will have jurisdiction over any dispute, except where mandatory consumer-protection law entitles you to bring proceedings in your country of residence.
